Terms and Conditions:

Welcome to EIGHTY2 on M. We strive to provide a smooth, enjoyable, and memorable stay. To help ensure the best possible experience for all guests, please familiarize yourself with the following policies. These Terms and Conditions outline the expectations and responsibilities of both guests and management. By staying with us, you agree to these terms, which cover key aspects such as reservations, payments, liabilities, and personal data protection.

1. Guest Responsibility and Authority

By signing the Registration Card, the guest confirms that they are authorized to act on behalf of all persons included in their party. The guest guarantees they can bind their party to these terms and agrees to be personally liable for any charges or damages incurred during their stay at EIGHTY2 on M. Should the guest lack such authority, they agree to be solely responsible for all related amounts.

2. Payment of Accommodation and Additional Charges

The guest, along with their party, agrees to pay the full room rate and any other incidental charges, including VAT (if applicable), no later than the time of departure unless prior written arrangements have been made with FLUENT’s management. All outstanding balances must be settled before checkout.

3. Proof of Indebtedness

A certificate issued by the General Manager shall serve as conclusive proof of the guest’s or their party’s indebtedness, including any particulars of the debt. This certificate will be valid in all legal proceedings initiated by FLUENT.

4. Forgotten Belongings

In the event of any belongings left behind, EIGHTY2 on M will make reasonable efforts to contact the guest using the email address provided at registration. If unclaimed after one month, the property reserves the right to donate or sell the items at its discretion. Alternatively, guests can request items to be couriered at their own expense.

5. Limitation of Liability

The guest, on behalf of themselves and their party, agrees that EIGHTY2 on M and FLUENT shall not be liable for any injury, death, or harm suffered by any guest, nor for any loss, damage, or destruction of property, regardless of the cause. This limitation applies even if such incidents arise from negligence (whether gross or ordinary), intentional misconduct, or acts of third parties, including subcontractors or employees of the property.

6. Jurisdiction and Legal Proceedings

The guest consents to the jurisdiction of the Magistrate’s Court that has authority over them for any disputes or legal matters arising from their stay at EIGHTY2 on M. However, FLUENT reserves the right to bring legal proceedings in any Division of the Supreme Court of South Africa with jurisdiction over the matter.

7. Interpretation

In these Terms and Conditions, where applicable:

• Words in the masculine gender shall include the feminine and vice versa.
• Words in the singular shall include the plural and vice versa.

8. Health and Safety

The guest agrees that FLUENT, including EIGHTY2 on M, its staff, and management, shall not be held liable if the guest or any member of their party contracts any illness or disease during their stay.

Roof Top and Swimming Pool Disclaimer:

Use of the swimming pool and the associated amenities and facilities is strictly at own risk.

The owners, managers and body corporate of these facilities do not accept and shall not incur any liability whatsoever for any injury or death of any person or the loss or destruction of, or damage to any property arising from the use of these facilities, regardless of the cause thereof.

Children below 12 are not allowed to use the swimming pool or the associated amenities and facilities unless they are accompanied by an adult.

9. Force Majeure

EIGHTY2 ON M and its management 7 Body Corporate is not liable for any failure to perform its obligations under these Terms and Conditions due to causes beyond its control, including natural disasters, pandemics, acts of government, or other emergencies.

10. Data Privacy and Security

We are committed to safeguarding all personal information obtained from guests. Your personal data, including copies of ID and credit cards, will be securely stored and only used for communication, verification, and legal purposes.

• Sharing of information: Personal data will not be disclosed to third parties unless required by law due to criminal activity involving the guest.
• CCTV footage: Surveillance is in place for security purposes only. Footage will not be shared, except in instances where criminal activity involving the guest is investigated.

All reasonable precautions will be taken to protect guests' personal information from unauthorized access.
